Wells Fargo tightens tough arbitration agreement

Wells Fargo recently notified checking and savings account customers that effective Feb. 15, its mandatory arbitration agreement - already one of the toughest in banking - will become even more ironclad.

And in 2010, the high court ruled that an arbitrator - not a court - could decide whether a company's forced arbitration agreement is so unfair as to be unenforceable. The name of that case is Rent-a-Center West vs. Jackson, but "it should have been the fox guarding the henhouse case," because it allows arbitrators to decide whether arbitration is fair, says Paul Bland, an attorney with Public Justice who helped argue the losing side of the case.

Hofmann's build accidental dynasty

The Munich-born brothers had left Germany in pursuit of change and adventure, embarking on the MV Aurelia with 1300 other assisted migrants bound for Sydney and the Bonegilla migrant centre when the vessel stopped over in Fremantle in 1959.

Johann, who goes by John nowadays, recalls that a superintendent from the now-defunct Chamberlain tractor factory in Welshpool came aboard seeking toolmakers. The Hofmanns and one other disembarked.

"We never intended to stay. We were going to wait two years, learn a lot, see a lot, have a lot of fun and go back (to Germany)," the 73-year-old says. Apart from short interludes back in Europe, he and his younger brother have been in WA since, building a visible legacy in one of the State's biggest family businesses.

Bassendean-based Hofmann Engineering has about 600 employees in WA, Victoria, Canada, Chile and India and turns over more than $130 million a year. More than half the revenue is drawn from export markets, including Germany. Forward orders for the next 18 months stand at $120 million.

The award-winning firm uses computer design technology to turn out products, including high-tech precision tools, valves and pumps, bearings, food packaging and aerospace parts, but its growth of late has been built on producing and refurbishing high-precision gearing for mining and mineral processing plants and wind turbines. Some of the gears are the biggest made in the southern hemisphere, measuring up to 15m in diameter and weighing more than 100 tonnes.

Three generations of the Hofmanns now work in the business, including both of John's sons, Erich J Hofmann, who succeeded his father as managing director eight years ago, and Mark, a metallurgical technician, as well as Erich Sr's daughter, Monika, an accountant who works with Hofmann's finance team.

Prime Minister Julia Gillard visited Hofmann's headquarters during CHOGM in October, holding the company up as an example for Australian industry. Recently a member of my Condo and HOA Law & Living group on LinkedIn asked the following question of our approximately 2,400 nationwide members.

“What is a condominium owner’s rights when his or her unit is saturated in secondhand smoke from the unit above them and below them? Are there laws that address this issue and, if so, have they been enforced in Florida?”

This question kicked off some heated discussion and resulted in an extraordinarily large number of comments both from smokers and non-smokers alike. Some of the commentary ran a little afield of the original question and veered off into topics ranging from the science on secondhand smoke to civil liberties and everything in between.

However, for the benefit of Sun Sentinel blog readers, I will repost my response to the question here:

The Plaintiff brought suit against the Defendant for damages based on the theories of trespass, common law nuisance and breach of contract. As it pertains to smoke, secondary authority has summarized the status of the law as it relates to trespass as follows: “A trespass need not be inflicted directly on another’s realty, but may be committed by discharging a foreign polluting matter at a point beyond the boundary of such realty.”

The Broward County Court found that the excessive nature of the smoke in this case did constitute a trespass. The Court also found that the excessive secondhand smoke had created an actionable nuisance for the Plaintiff. The Broward County Court also cited the Court of Appeals of Nebraska which had held that to have the use and enjoyment of one’s home interfered with by smoke, odor and similar attacks upon one’s senses is a serious harm.

Lastly, the Broward County Court addressed whether the excessive secondhand smoke constituted a breach of covenant of quiet enjoyment. The Court acknowledged that in Florida there was no case on point but relied on a Massachusetts Housing Court Ruling in 50-58 Gainsborough Street Realty Trust v. The only weakness in the Plaintiff’s case in Merrill v. Bosser is that she failed to provide competent evidence demonstrating the extent of her damages. The Court awarded her the sum of $1,000 plus costs in the amount of $275.00 to cover medical expenses, loss of use of the premises and remedial expenses.

It is important to note that this is a case where an owner sued an owner. It is not a case where an association sued an owner for violation of the covenants or for a nuisance. However, the arguments set forth in this case could, in my opinion, be used equally by a fellow owner or the association upon whom responsiblity to enforce the covenants rests.

Transfer between TLC plates for sampling with liquid microjunction interfac

The new generation of mass spectrometric techniques that allow ionisation in the open air at atmospheric pressure has created a great degree of excitement in the scientific community, largely due to two principal characteristics. The ability to analyse samples in situ and without any pre-treatment has opened up new avenues of investigation.

For instance, the surfaces of intact fruit can be screened for pesticides; clothing and baggage for traces of drugs or explosives; human tissue for tumours at the operating table; inks on paper in counterfeiting cases. The list of potential analytes and sample surface types appears to be endless but not all of the ambient techniques are quite this straightforward.

The liquid microjunction surface sampling probe functions by wetting the sample surface with a solvent which extracts analytes then is withdrawn through a tube to the ionisation source. This mechanism is not always successful, especially when the surface is absorbent and/or wettable. The solvent can wash the analytes away from the vicinity of the probe and can be absorbed into the surface to prevent subsequent extraction by the probe.

This is a recognised problem with certain hydrophilic high-performance TLC plates,Smooth-On is your source for Mold Making and casting materials including silicone rubber and urethane rubber, so their analysis is difficult using the LMJ-SSP. The blots were analysed using the LMJ-SSP by scanning across the plate, using a solvent of acidified acetonitrile in the liquid microjunction. The extracted ion chromatograms were of a similar shape and possessed the same retention factors as the bands on the original TLC plate. Good mass spectra of each peptide were recorded, with protonated or sodiated molecules as the strongest peaks, as expected.

The blotting process was carried out successfully at room temperature. The use of elevated temperatures would be expected to give improved peptide transfer but gave reduced signals in this case, possibly due to the instability of the peptides on the TLC plate. So, blotting circumvented the problem of wettable or hydrophilic surfaces when analysed by mass spectrometry using the LMJ-SSP.
